What is a trademark class?
In India, trademarks are registered in 45 classes under the Nice Classification. Classes 1 to 34 cover goods and classes 35 to 45 cover services. Your trademark is protected only in the classes you register it in.
- For example, if you run a café called "Chai Point" (Class 43) and also sell packaged tea (Class 30), you should apply in both classes.
- If you choose the wrong class, the trademark will not protect your actual business.
- A separate fee is payable for each class.
Trademark government fee
| Applicant | E-filing fee per class |
|---|---|
| Individual, startup or small enterprise (MSME) | ₹4,500 |
| Company or others | ₹9,000 |
Tip: if you sell online through your own website, apply in Class 35 (online retail) along with your product class. Software and app businesses usually apply in both Class 9 and Class 42.
